How Much Worse Are Work-Zone Tickets?

Much worse. Under the Work-Zone Safety Law, drivers stopped in active work-zones face increased fines and potential suspensions. Some offenses which carry far more serious consequences in active work-zones include:
  • Speeding 11mph and over the posted speed limit in an active work-zone
  • Failing to drive at a safe speed; and
  • Traffic citations issued as a result of a Motor Vehicle Accident.
If you are found guilty of any of these violations, you will automatically face a fifteen-day Suspension of Your Driving Privileges. In addition to the citations which carry a mandatory suspension, most fines for motor vehicle violations in an active work-zone will be doubled, resulting in costly fines, in addition to the normal penalties of the violation. If those violations carry points, you will be paying a significant amount of money both on increased insurance premiums and fines. If you are cited for a traffic violation which carries jail time, such as homicide by vehicle for a crash, and the violation occurs in an active work-zone, the Work-Zone Safety Law calls for an additional term of imprisonment of up to five years.

While the Courts look very seriously at violations which occur in a work-zone, there are defenses that can be raised. Most commonly, there must be some sort of posting or notification that you are in an active work zone. This is done to notify motorists that they are entering a work-zone. There is typically a white flashing light attached to the active work-zone sign that serves to indicate that workers are present.
